What Texas law says about liability waivers

Express negligence doctrine

Intent to release the provider's own negligence must be stated explicitly within the document, using the word "negligence" (Dresser Industries v. Page Petroleum, 1993).

Conspicuousness

The release must stand out — e.g. a heading in capitals at least as large as surrounding text, or contrasting type. It cannot be buried in fine print.

Gross negligence — never

Texas will not enforce a release of gross negligence or intentional misconduct.

Minors in Texas

Texas appellate law (Munoz v. II Jaz, 1993) holds a parent cannot waive a minor child's personal-injury claim; federal courts applying Texas law have followed it. The Texas Supreme Court has not decided the point, so treat parental waivers for minors as unenforceable.

What operators can do

Pay close attention to formatting: name negligence expressly and make the release conspicuous. Equine operations must also use the Chapter 87 warning. Confirm with a Texas attorney.
