Montana Code § 28-2-702 voids contracts that exempt a party from responsibility for their own negligence — except a waiver that complies with § 27-1-753.

Equipment claims survive

Even a compliant waiver does not cover claims based on the design, manufacture, provision, or maintenance of equipment — or gross negligence / willful conduct.

Montana requires this exact warning, in bold, for a recreation waiver to be enforceable:

By signing this document you may be waiving your legal right to a jury trial to hold the provider legally responsible for any injuries or damages resulting from risks inherent in the sport or recreational opportunity or for any injuries or damages you may suffer due to the provider's ordinary negligence that are the result of the provider's failure to exercise reasonable care.

Reproduce the wording exactly and in bold typeface. Without it, the waiver is void by default.

Minors in Montana

Montana's recreation-waiver statute is silent on minors and no case squarely resolves it — do not assume a parent-signed minor waiver is enforceable.
